Aspiration & Choking Events

Eating Should Never Be a Life-Threatening Activity

For many nursing home residents, swallowing is not automatic; it is a medical risk that requires planning, training, and vigilance. Dysphagia, neurological disease, muscle weakness, sedation, and cognitive decline can all make ordinary meals dangerous.

When facilities fail to identify those risks or ignore them, residents can aspirate food or liquids into the lungs, suffer airway obstruction, or experience prolonged oxygen deprivation. These events are frequently catastrophic, and too often fatal.

Aspiration and choking cases are not “unfortunate accidents.” They are usually the final outcome of preventable systemic failures.

How Aspiration Injures and Kills

Aspiration occurs when food, liquid, or saliva enters the airway instead of the esophagus. Choking happens when the airway is physically blocked. Both can cause devastating consequences, including:

  • Anoxic brain injury from oxygen deprivation
  • Aspiration pneumonia and sepsis
  • Cardiac arrest during a choking episode
  • Permanent neurological impairment
  • Wrongful death

In many cases, residents survive the initial event only to deteriorate rapidly due to infection, respiratory failure, or delayed treatment.

The Red Flags We Investigate

Aspiration and choking claims often involve clear warning signs that were ignored. Our investigations focus on whether the facility failed to:

  • Conduct proper swallow evaluations after stroke, illness, or decline
  • Implement prescribed diet modifications (pureed, thickened liquids, mechanical soft)
  • Ensure one-to-one supervision during meals for high-risk residents
  • Monitor residents positioned improperly while eating
  • Train staff to recognize choking and aspiration distress
  • Respond immediately and appropriately to airway emergencies

These failures are not isolated errors they reflect breakdowns in care planning, staffing, and accountability.

Accountability Beyond the Bedside

Responsibility may extend beyond individual caregivers. Depending on the facts, liable parties may include:

  • Nursing home operators and management companies
  • Administrators responsible for staffing and training
  • Contracted speech or dietary providers
  • Corporate owners that imposed unsafe cost-cutting policies

These cases demand careful medical review and a willingness to confront institutional neglect.

How We Approach Aspiration & Choking Cases

McEldrew Purtell handles these matters as catastrophic injury and wrongful death cases, not routine negligence claims. We work with medical experts to reconstruct what happened and what should have happened to determine whether a resident’s life was lost due to preventable neglect.

Our focus is simple: exposing failures that never should have occurred and pursuing outcomes that reflect the true human cost.
