McEldrew Purtell, P.C. (“McEldrew Purtell,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect, how we use and disclose it, and your choices. It applies to information collected through our website (mceldrewpurtell.com) and any webpage linking to this Privacy Policy (the “Site”), our email communications, social media pages, and other online services we operate (together, the “Platform”).

If you are a current client, some parts of the Platform may be used to communicate within an attorney–client relationship. Nothing in this Policy limits our obligations of confidentiality and privilege to our clients.


Information We Collect

The types of personal information we collect depend on how you interact with us and the services you request. Examples include:

Identifiers & Contact Details. Name, mailing address, email address, phone number, job title, organization, IP address, device IDs, and other online identifiers.

Demographic & Case Information. Date of birth, gender, age, marital status, and facts you share in connection with a consultation, lead form, referral, or legal matter.

Sensitive Personal Information. Government ID numbers (e.g., Social Security and driver’s license numbers), financial and insurance information (e.g., bank account or policy numbers), medical and health information relevant to a potential or current case, and precise geolocation if you enable it in an app or browser.

Commercial & Account Information. Account credentials (if you create an account), communications with us (including call recordings where permitted by law), documents and media you upload, representation details, invoices and settlement/claim payment information.

Internet/Network Activity & Device Data. Pages viewed, referring/exit pages, time on page, links clicked, scroll and interaction data, approximate location (e.g., city/state), browser and operating system, and similar usage information collected via cookies, pixels, local storage, SDKs, session-replay or similar technologies.

Inferences. Profiles or inferences drawn from the above to understand preferences and Platform usage.

Sources. We collect personal information directly from you; automatically from your device and browser; from our service providers and business partners (such as analytics and advertising providers); from referral sources (including other attorneys and community partners); from public sources; and from individuals or entities involved in your matter (e.g., healthcare providers, insurers, or other parties) where appropriate.


How We Use Personal Information

We use personal information to:

  • Comply with law and enforce our terms, and protect rights, privacy, safety, and property.
  • Provide, operate, troubleshoot, and improve the Platform and our services;
  • Evaluate and respond to inquiries, free case evaluations, and referrals, and determine legal needs;
  • Communicate with you, including to send updates, marketing communications (you may opt out), and service messages;
  • Create, manage, and secure accounts and features; process transactions and payments; and personalize your experience;
  • Conduct research and development (including by generating aggregated, de-identified, or anonymized data);
  • Detect, investigate, and prevent security incidents, fraud, and other unlawful or unsafe activity;

Cookies, Analytics, and Advertising

We and our service providers use cookies and similar technologies (such as pixels, local storage, SDKs, session‑replay, and call‑recording tools where permitted) to measure and improve the Platform, remember preferences, and, where allowed, support interest‑based advertising. You can control cookies at the browser level; disabling cookies may affect some functionality.

We may use analytics tools (e.g., Google Analytics) to help us understand usage of the Platform and improve performance. You can learn about browser add‑ons and opt‑out features provided by analytics vendors and control some ad preferences through your device or platform settings.


Disclosure of Personal Information

We may disclose personal information to:

  • Service providers and vendors who process data on our behalf (e.g., hosting, analytics, advertising partners, customer support, communications, payment processing, and IT/security);
  • Co‑counsel, experts, investigators, referral or local counsel, and opposing/third parties as appropriate in connection with a matter or as you direct;
  • Business partners, social networks, and third‑party platforms when you engage with features that interact with those services;
  • Authorities and others when required by law, subpoena, or to protect rights, safety, and property; and
  • Successors/assignees in the event of a merger, reorganization, or similar transaction.

We may share de‑identified or aggregated information that does not identify you.


Your Choices & Rights

Marketing Communications. You may unsubscribe from promotional emails by using the link in those messages. For text/SMS marketing, see Section 6 below.

Browser/Device Controls. You can manage cookies and other tracking technologies via your browser settings and device permissions.

Your Privacy Rights. Depending on your state of residence, you may have rights to request access, correction, deletion, or portability of personal information; to opt out of certain processing for targeted advertising or profiling; and to limit use/disclosure of sensitive personal information. To exercise rights, contact us using the information in Section 12. We will verify requests as required by law and will not discriminate against you for exercising your rights.

Do Not Track. We currently do not respond to browser “Do Not Track” signals.


Text/SMS Messaging Terms

By subscribing to McEldrew Purtell SMS services, you agree to receive texts from us about your inquiry or services. Message frequency may vary. You may opt out at any time by replying STOP; for help, reply HELP. Standard message and data rates may apply. We do not sell mobile opt‑in data or disclose it to third parties for their own marketing.


Children’s Privacy

Our Platform is not intended for children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us and we will take appropriate steps to delete such information.


Security

We use administrative, technical, and physical safeguards designed to help protect personal information. No security program is perfect, and we cannot guarantee absolute security of information.


Data Retention

We retain personal information for as long as needed to provide services, comply with legal obligations (including professional responsibilities), resolve disputes, and enforce our agreements.

Links to Other Websites

The Platform may link to third‑party websites and services. Their privacy practices are governed by their own policies; we are not responsible for their content or practices.


International Visitors

Our Platform is intended for people in the United States. If you access the Platform from outside the U.S., you understand that your information may be transferred to, stored in, and processed in the United States.

State‑Specific Notices (California and other U.S. states)

Residents of certain states (including California, Colorado, Connecticut, Virginia, and Utah) have additional rights regarding personal information. This section supplements the rest of this Policy for those residents.

  • Categories of personal information collected. See Section 1 for the categories we collect. We collect these categories for the business purposes described in Section 2 and disclose them as described in Section 4.
  • Sources of personal information. See Section 1 (Sources).
  • Sensitive personal information. We collect limited sensitive personal information (e.g., government IDs, precise geolocation if enabled, health/medical details relevant to a matter) and use or disclose it only for permitted purposes.
  • Targeted advertising / “sale” or “sharing.” We do not sell personal information for money. We may engage in online advertising that could be considered “sharing” or “targeted advertising” under certain state laws. You may opt out of such activities by adjusting cookie preferences, using platform ad settings, or contacting us.
  • Data retention. See Section 9.
  • Your state privacy rights. Subject to verification and legal exceptions, you may request access, correction, deletion, portability, or to opt out of targeted advertising. Authorized agents may submit requests with proof of authority. To exercise, contact us per Section 12 and indicate your state of residence. We will not discriminate against you for exercising your rights.

We may update this Privacy Policy from time to time. The “Last updated” date indicates when this Policy was last revised. Material changes will be effective when posted unless otherwise stated. Your continued use of the Platform after changes are posted signifies acceptance of the updated Policy.
