What is FELA?
The Federal Employersâ Liability Act (FELA) allows injured railroad employees to recover damages when the railroadâs negligence played any part in causing the injury. Unlike no-fault workersâ comp, FELA requires proof of negligence but allows broader damages (medical costs, wage loss/earning capacity, and pain and suffering). Most claims must be filed within three years – donât wait.
